Welcome to GeneralMedia LLC! By using our media spend management platform (the “Service”), you agree to the following terms and conditions (the “Terms”). Please read these Terms carefully. If you do not agree to these Terms, do not use the Service.
- Services Provided
GeneralMedia LLC (“we,” “us,” or “our”) offers a media spend management platform that allows clients (“you” or “your”) to allocate budgets for advertisement purchases exclusively on Alphabet companies (such as Google and YouTube) and Facebook. - Use of the Service
– Authorized Use: You agree to use the Service solely for purchasing advertisements on Alphabet companies and Facebook. You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations.
– Account Security: You are responsible for maintaining the security of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information. - Client Deposits
– Deposits: You may deposit funds into your account for use in purchasing advertisements. Deposits are not insured by the Federal Deposit Insurance Corporation (FDIC) or any other governmental agency.
– Return of Deposits: Upon termination of your account or upon request, we will return the remaining balance of your deposits. We will make our best effort to return funds promptly but are not liable for delays caused by third-party payment processors.
– Third-Party Processors: We use third-party payment processing partners to handle transactions. We are not responsible for any loss of deposits due to a payment processor going out of business but will make our best effort to recover such funds on your behalf. - Limitations of Liability
– No Responsibility for Misuse: We are not responsible for the inadequate use of your budgets. While we make best efforts to ensure that balances in your account are spent solely on advertisements on Alphabet companies and Facebook, we are not accountable for your violations of these Terms or any misuse of the Service.
– No Warranties: The Service is provided “as is” and “as available,” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted or error-free. - Indemnification
You agree to indemnify, defend, and hold harmless GeneralMedia LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your use of the Service or violation of these Terms. - Termination
We reserve the right to terminate or suspend your access to the Service at any time, with or without cause, and without notice or liability to you. - Governing Law
These Terms are governed by and construed in accordance with the laws of the State of WY, United States, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the state and federal courts located in Sheridan county, WY, for the purpose of litigating all such claims or disputes. - Changes to Terms
We may modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. - Contact Information
